Australia’s High Court – the highest court in the land – will finally rule on the trademark dispute between the two Perrys that has played out across lower courts for several years.

Katie Jane Taylor, the Australian designer with a fashion label named ‘Katie Perry’, claims that Katheryn Hudson — known to most as popstar Katy Perry — has infringed on her trademark.

Taylor launched her fashion brand in 2006, and registered the name as a trademark in 2009, prior to Katy Perry’s career taking off in Australia. Ten years later, the designer successfully sued the popstar over clothing sales on her Australia tour which infringed on the designer’s trademark. However, on appeal last year, the ruling was overturned. The Katie Perry trademark, the court stated, should never have been granted, and it ordered the designer’s mark canceled.

“Whilst some die-hard fans of (Katy Perry the popstar) may recognize the incorrect spelling, the ordinary consumer with an imperfect recollection … would be likely to be confused as to the source of the item and wonder whether it was associated with (the popstar),” the judges wrote.

It was noted that in 2009 Popstar Perry had sent a “cease and desist” letter to the Sydney-based fashion designer, before suggesting they come to a “coexistence agreement”. The fashion designer rejected this offer

The High Court, worried that the appeal’s court ruling will set a troubling precedent – is now revisiting the case.
